Welcome to PalmR8D, the world’s first AI-powered Social Validation Marketplace Platform connecting users, creators, and businesses across food, culture, and commerce.

These Terms of Use (“Terms”) govern your access to and use of the PalmR8D mobile app, website, and services (collectively, the “Platform”) operated by PalmR8D, Inc. (“we,” “us,” “our”).

By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. 

Eligibility

To use PalmR8D, you must:

• Be at least 13 years old (or the age of digital consent in your country)
• Have legal capacity to enter into a binding agreement
• Use the Platform in compliance with all applicable laws

If you’re registering on behalf of a business, you confirm that you are authorized to act on its behalf.

2. 

Accounts and User Roles

You may create one account with multiple roles (e.g., Foodie, Home Chef, Restaurant, Bartender, Brand, etc.).

You are responsible for:

• Keeping your login credentials secure
• All activity under your account
• Maintaining accurate, up-to-date profile information

We reserve the right to suspend or delete accounts that violate our policies or harm the community.

3. 

Platform Features

PalmR8D enables users to:

• Share photos, videos, and reviews
• Connect with and message other users
• Sell, order, or reserve services and experiences
• Rate and rank profiles, dishes, and businesses
• Build a public validation record and climb leaderboards

Feature access may vary based on your subscription tier or role type.

4. 

Payments and Subscriptions

• Payments are processed securely through third-party providers.
• Sellers and businesses are charged a 15%-30% commission per transaction.
• Subscription tiers (e.g., Tier 1, 2, 3) provide enhanced visibility, analytics, and tools.
• All subscription fees are billed monthly unless otherwise specified.
• You may cancel your subscription anytime in your account settings.

No refunds are issued for unused time or features unless required by law.

5. 

Community Guidelines

You agree not to:

• Post harmful, hateful, or illegal content
• Impersonate others or misrepresent your identity
• Spam, harass, or exploit users
• Violate intellectual property rights
• Circumvent fees or security features

We reserve the right to remove content, suspend access, or ban users who violate these guidelines.

Content Ownership and Rights

• You retain ownership of content you post (photos, reviews, menus, videos).
• By uploading content, you grant PalmR8D a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and promote that content within the Platform.
• You may not use others’ content without permission.

Privacy

Your use of PalmR8D is also governed by our Privacy Policy, which explains how we collect, store, and use your data.

Disclaimers

• We make no guarantees regarding the availability, accuracy, or performance of the Platform.
• We are not responsible for the behavior, quality, or services of other users or businesses.
• All transactions and interactions are between users at their own risk.

9. 

Limitation of Liability

To the maximum extent allowed by law, PalmR8D is not liable for:

• Indirect, incidental, or consequential damages
• Loss of data, reputation, profits, or opportunities
• Disputes or issues arising from user interactions

Our total liability will not exceed the greater of $100 or the amount you paid us in the last 12 months.

10. 

Termination

You may delete your account at any time.

PalmR8D reserves the right to suspend or terminate your access if you breach these Terms or misuse the Platform. Termination does not affect any outstanding obligations or rights accrued prior to termination.

11. 

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or via the app. Continued use of the Platform after changes go into effect constitutes your acceptance.

12. 

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Disputes must be brought in the state or federal courts located in Oakland, California.
